Public enemy No. 1 Irwin Schiff is in chains and being held without bond as a flight risk in the Las Vegas City Jail, as the 77-year-old tax crook was recently convicted last week on 14 counts of income tax evasion.

Now that’s the bogus headline the government wants America to read and believe about the freedom-fighting tax guru who claims income taxes have been illegally collected for years.

But the real criminals in this unfortunate case are those professing to uphold justice, being “Moe, Curly and Larry,   the nicknames given to the Schiff prosecution team, as well as the two-bit, crooked card-dealing Las Vegas federal judge named Kent Dawson, who essentially railroaded Schiff right to the slammer.

Now that’s a bold statement, one these legal bozos aren’t used to hearing and one not usually associated with so-called “officers of the court. 

But if the shoe fits, wear it.

And in this case the “judicial shoes   are a perfect fit for nothing less than a “judicial fix   in order to keep the government charade going that income taxes are legal and constitutional.

For lack of a better explanation and without presenting a 500 page legal argument, the constitutionality and legality of the income tax law is an outright lie and nothing but a legal fantasy, a legal myth being perpetuated by every federal judge, prosecutor and IRS agent in the land determined in keeping the “cash cow   safely bedded down in Uncle Sam’s barn.

Anyone with half a brain who reads the constitution and its related tax cases has really no choice but to come to the same conclusion, the undisputable conclusion that the collection of income taxes is unconstitutional.

But what’s right, just and fair and, for that matter constitutional, means nothing when it comes to disrupting the government’s cash flow. And Schiff is just another example in the long line of people abused, used and thrown to the dogs by a group of judicial rats, lacking any type of integrity, honor or sense of fair play.

“The judge in Irwin’s case was a complete and utter tyrant,   said Mike Golden, a close friend of Schiff who sat by his side every day through out the two-month trial. “Dawson ought to be thrown off the bench and to say that Irwin was railroaded was an understatement.

“I watched and listened to the entire proceeding and there were many in the courtroom whose jaws were dropping by the conduct of the so-called. He made no bones about it that he didn’t like Irwin, having the audacity in open court on the third or fourth day to even say and I quote: ‘The law has nothing to do with the trial. 

“Behind closed doors Dawson even told Irwin that if he tries to introduce law into his court, every time he does it he’ll get one day in jail. I could see the judge counting the days while Irwin talked without the jury knowing and I think even if he wasn’t convicted he would have spent at least six years in jail just on contempt charges..

“It was nothing less than a judicial joke and I even nicknamed the prosecutors, who looked like the Three Stooges, Moe, Curly and Larry. I was kicked out of court several times for making comments, but when they got word of their nicknames, I even heard them call each other the names of the Stooges. 

Despite the intermittent levity, the Schiff federal trial from a legal prospective became a kangaroo court, according to Golden, other legal observers and Schiff’s new appellate attorney, Mike Nash of Chicago.

Nash, an attorney with 30 years appellate experience, came on the scene several days ago as Schiff finally became convinced outside legal help may be his only chance of survival and not dying in jail in the face of what he now fully understands is a corrupt system bent on putting him away for life.

“Mike saw Irwin just a couple of days ago and is trying to keep his spirits up and is confident the trial errors in this case will eventually set Irwin free,   said Golden, adding that when he first visited Schiff in jail last week he was kept in chains and deprived of adequate blanketing in a cold and damp jail cell. “I have been a paramedic and let me tell you Irwin looked like he was on his last legs. While the other prisoners were walking without cuffs, here we have a 77-year-old man held without and as a flight risk and still kept in manacles. 

“He was given no blankets and when I saw him, he damn near fell off the chair he was sitting because he was so cold and weak. 

Also commenting on the unfairness of the Schiff conviction was Phil Hart, a Republican State Legislator from Idaho, who has written an extensive book called “Constitutional Income   that presents a solid legal argument that the income tax laws are an unjust tax as well as blatantly unconstitutional.

“The government just doesn’t want to listen to the arguments and Irwin’s case is a prime example,   said Hart this week from his Idaho office, adding his research about income taxes dates all the way back to the Magna Carta. “Until Americans are educated about their own constitutional in relation to the income tax laws and until they want to change things as they are today, the government will continue to unfairly tax its citizens.

“The only way to change things is to get enough political momentum and people behind the unconstitutional nature of the income tax laws. 

Despite arguments made by people like Schiff and Rep. Hart, the attorneys for the Justice Department’s tax Division had a different take on the Schiff prosecution.

“People who evade their tax obligations, or encourage or enable others to do so, are cheating all law-abiding taxpayers,   said Eileen O’Connor, assistant attorney general for the Justice Department’s Tax Division, adding this marks the third time Schiff, who served as his own attorney during the five-week trial, has been convicted of tax-related offenses.

“Paying taxes is the price of citizenship. After three times, I would hope that even Schiff realizes that he has struck out," said Internal Revenue Service Commissioner Mark Everson.

Schiff, who will be sentenced in January 20, faces a maximum term of 43 years in prison and $3.25 million in fines for charges including income tax evasion and filing false tax returns for the years 1997 through 2002.

Cynthia Neun, 52, a co-defendant, faces up to 50 years and $3.3 million in fines, convicted on 15 counts, including conspiracy, tax evasion, aiding in the filing of fraudulent tax returns.

A third co-defendant, Lawrence Cohen, 65, was found guilty of one count of aiding in the filing of fraudulent tax returns and acquitted on three other counts of the same charge, and of conspiracy.

For years, Schiff has been holding tax seminars and selling books such as "The Federal Mafia: How the Government Illegally Imposes and Unlawfully Collects Income Taxes" and “The Great Income Tax Hoax: Why You Can Immediately Stop Paying This Illegally Enforced Tax.

I personally found Schiff to be a dislikable personality.  I think he intentionally led people into harm's way by encouraging them to drop out of the income tax system, knowing full well they would suffer major troubles at the hands of the IRS and federal courts.   However, I am still very upset to see him jailed on tax evasion charges, because I am convinced that he is legally correct in his views, and it is the criminal nature of the federal government itself that allows people to get in trouble by following his advice.  I think this is an especially notable conviction, because Schiff has been promoting his ideas in books and lectures for 15 or 20 years now, and it is only now that they have finally managed to get him on serious criminal charges.

His books are excellent and well-worth reading, containing some very interesting and concrete legal explanations of constitutionally-protected individual rights in the USA, and the specific methods by which the government systematically sidesteps and tramples directly over them in its "enforcement" of tax policies (not laws).     The court banned him from selling his own books, but they're still available via Amazon and elsewhere ... for the moment, anyway.  Anyone who's interested in collecting books for the purpose of preserving information in the coming dark times might want to pick up some of Schiff's works; they're a worthy addition to any library.

This makes me mad as hell. Schiff is a political prisoner and a true patriot. It is unfortunate that his advise places people in trouble with the government. The quote that taxes is the price we pay for citizenship is indeed instructive: citizens exist for the benefit of the State. Period. Any dissent will be punished.

Tax evasion seems to be the American way to jail heretics
They did the same to Ec McCabe the writer and reseacher and expert on oxygen therapies that the pharma companies and the FDA have kept suppressed for years.
Still Ed got his own back he emerged from prison not bitter and wrote wrote another superb best selling book getting out more information that they dont want us to know about.
And when Ed revealed in his book that many of the top directors of pharma companies, the FDA etc etc went to germany/mexico to use the ozone clinics themsleves and for their families, that was sweet justice.

Its not like we are fractions of the whole but rather versions of the whole.

       Irwin Schiff has been vindicated within the latest issue (2006) of the prestigious Seton Hall University Law Review.

       The 39 page law review article concludes that Irwin had every right to sell The Federal Mafia because its contents were undeniably protected by the First Amendment.  According to this in-depth article, the U.S. District Court(Judge Lloyd George) was wrong to issue an injunction against Irwin and Freedom Books and the 9th Circuit was incorrect in upholding the
injunction.

       This marks the second time that Irwin has been vindicated by an "establishment" law review article.  The first time, in 1987, the Journal of Taxation published an article in which it was stated that Irwin's then recent conviction for tax evasion (in a Connecticut U.S. District Court)overturned "40 years of settled tax law."

I'm not sure exactly how it is in the US, but in Britain and her Commonwealth (including Canada), persons are not required to pay income tax, and many other in-place forms of taxation and usury, because the established laws, acts and bills do not apply to one affirming his existence as a "natural person".  (Natural persons do not have to totally "check out" of the system, either.)

However - income tax, etc apply to an "articifical person" as in the corporation that almost all born human beings exist as.

So, 99.99% of people do not know and/or affirm their rights.

However, if one simply but knowledgeably asserts his or herself as existing as a "natural person" (essentially saying "I am not the corporation that was created in a similar name with uppercase letters....") and thus does not waive their basic human rights as confirmed in the Bill of Rights and many other pieces of legislation, the tables do in fact turn.  I added the word "knowledgeably" because you may be required to back that up, so you don't succumb to intimidation and underhanded tactics.  But you don't have to be or even have a lawyer.  As of late, court cases are getting thrown out because people are showing up in court as their "natural person" ie: John Doe -- not as their legal slave corporation -- JOHN DOE -- and tax and usury related cases are being dismissed.

Fear and intimidation is of course drilled into people so they do not ever get to this point.... well *rarely* I should say.

There are steps to be taken to establish and affirm one's freedom this tax/usury subjection - the first and foremost being arming yourself with the appropriate knowledge.

This is hush-hush here, but there are organizations that are dedicated to educating people of these rights.

This is something I am just becoming aware of, and would be happy to share more information should there be interest.  My understanding is that the basic precepts are applicable to United States persons as well, though would not be the exactly same legal path followed to arrive at that same destination.  Sounds absurd, I know! 

But income tax subjected to any corporation-person (JOHN DOE) is *NOT* illegal, at least in the Commonwealth.  What is illegal is income tax subjected to any 'natural person'... that is one who affirms his rights and exsitence under the applicable human rights legislations in effect (Bill of Rights, BNA Act, etc).

C.I.R. v. Duke of Westminster wrote:

"Every man is entitled, if he can, to order his affairs so that the tax
attaching under the appropriate Acts is less than it otherwise would be.
If  he succeeds in ordering them so as to secure this result, then,
however  unappreciative the Government or his fellow taxpayers may be of
his ingenuity, he cannot be compelled to pay an increased tax."

12 per Lord Simonds in Russel v Scott (1948)A.C. 422 at p. 433 wrote:

“The subject is not to be taxed unless the words of the taxing statute
unambiguously impose the tax upon him” .

So, you can't overturn the whole system and say "the whole thing is illegal", at least here - because, it's legal.  But you can legally choose to not pay ambiguously voluntary taxes if you arm yourself with knowledge on the subject.

That idea has been floating around here in the USA for a long time too.  All sorts of different people are following "redemption" and other unusual legal theories based on the Uniform Commercial Code and stuff like that.  I know of no one anywhere who has had any success pursuing those ideas, but plenty of cases of people getting in trouble for it.     And plenty of people making BIG MONEY by selling the information:  $500 for "Amazing Info Packet #1" which tells you how to drop out of the system, then $3,500.00 for "Amazing Info Packet #2" which tells you what to say to the teenage bank teller when your account is frozen as a result of your having used the information in Packet #1 and so forth.   Then for ten grand you can get Packet C which explains to you why the Federal Judge was violating your rights by sentencing you to a lengthy prison term for passing bad checks even though you were using capital letters, and how you can best phrase your appeal.    Be careful!  Just because something sounds good doesn't mean it will be effective.   I can tell you for a fact that Schiff's material is crystal clear and has NOTHING to do with strange ideas like capital-letter names, his material is based on legitimate "normal" law, and yet he is STILL IN PRISON and IS BANNED FROM SELLING HIS BOOK.   So if they can do that to him when he's clearly right, then it doesn't take much imagination to realize that theories which are based on bizarre subjective interpretations of the law are incredibly easy targets for prosecution. 

The bottom line is that even if there IS a conspiracy to enslave us by using legally-fictitious capital-letter-name straw-men, what that should tell you is that the system is SO corrupt that you don't stand a chance fighting it in the first place.    Either way, you're dealing with high-level organized crime.

I'd strongly recommend that anyone considering acting based on strange-sounding legal advice to proceed with extreme caution.   In this day and age there are plenty of more useful things you can do to help yourself and the world, like participating here on NR and continuing to READ and EDUCATE yourself.   Going to jail defending some odd legal idea that no one can understand is not going to help anyone.    Choose your battles.   And don't eat the white mushrooms.

Morningsun, you're mistaken about this.  Cases have gotten and are getting thrown out of court here.  Be careful about perpetuating this aspect of matrix by encouraging others to be so skeptical and fearful of learning about it.  You're blanketing your experiences a) in another country, with different laws; and b) with spammers; over what I am talking about, which is something completely different.

Well, it's quite possible I could be missing something.  I know I've read about a lot of people getting in various kinds of trouble here in the US, but that doesn't necessarily mean there aren't other aspects to the story that I'm just unaware of.  The website you linked looks quite interesting, and I'll try and read through it as soon as I have the time.

You might try WinAVI Video Converter to convert a DVD to an RM or AVI file (but not flash).  If the DVD is copy-protected you'll also need a program like AnyDVD to crack the encryption before you can convert the video down to a more managable size and format.

One option you can look at is Google Video.  I'm using that now for the Karla Turner site and a few other things.  They host the file and stream it for free, while also giving you code to embed it within your own website as if it were hosted there.  It's pretty good.

I have WinAVI already from another project, didn't know if can rip a DVD, so that's a plus smile... and will see if the DVD's copy-protected.  Thanks for the links...

Nobody's interested in this?  tongue  I find that surprising... cases have been tossed out of court in Canada once the court sees the individual has made a conscious, informed and legal decision to function in his capacity as a "natural person" and not an "artificial" one.  (Artificial meaning the corporation they set up for you when you're born, with a SSN/SIN.)  And apparently almost all cases now get dropped in the initial stages - way before court.

Hi visavis.

I am interested in this and I have study the issue.

This has always been the sticking point for me ; when the system is corrupt, it doesn't matter what my rights are.

I think before this problem can be solved the corruptness needs to be exposed and people need to stand up. That's why freedom fighters like Schiff are important, to get the ball rolling.

Even when Gandhi led his peaceful uprising in India a few people got shot.

Google, I couldn't agree more with the understanding that the corruptness needs to be exposed and people need to stand up. 

For most, it will take something within their frame of reference to really have an impact -- because the massive amounts of programming from within our society has greatly lessened the ability of most to think outside the box in this regard. 

So an avenue of exposing that which directly affects their day-to-day life, like a corrupt tax system and an understanding of its history and key elements, can help spark the awareness to see that it's not just certain taxes or certain politicians which are corrupt, it's the whole damn foundation of our current society itself.
